Good afternoon,

I have reviewed the FF'd evaluation form for the former Food-N-Fuel site, in St. Francis, Leak #18925, and below is a copy of my comments entered in Remarks.

"1/8/14 (Milless) Reviewed FUND-FINANCED evaluation form, and recommend taking over FF'd, and assigning to Kathryn Serier. The RP (MDW Equity LLC) has claimed financial hardship.  Hardship claim has been referred to Dept of Commerce, and Commerce has confirmed financial hardship on 11/7/13. It should be noted that previous owners/operators, Avanti Petroleum and Twin Cities Stores Inc., were previously determined to be RPs however due to financial hardship and/or inactive corporation status, are not considered viable RPs (per AG advice).  Commissioner’s Order was issued 12/9/13.  Cost Recovery referred to Commerce. RP DOES own the leaksite property.  Environmental status: (See FF'd form and Remarks)." 

Kathryn, please work with Sarah Larsen on contractor assignment.  I estimated $25,000 to complete an LSI, and entered in TALES FF’d tab.  Please import this email and attachments into OnBase.

Joel, it is my understanding that Petrofund has made the financial hardship determination, and I assume you will continue to evaluate the lien option based on the RP owning the leaksite property.
