Minn. Stat. §115C.04, subd. 3 provides that the Petrofund may recover from a responsible person (RP) reasonable and necessary costs incurred by the MPCA in taking a corrective action at the RP's leaksite. Please consider this email as notification that the Petrofund will not be making efforts to recover corrective action costs incurred by the MPCA as part of the fund-financed work associated with the following leak site. The basis for this determination is that the Petrofund has determined that the RP does not have the financial means to pay for the corrective action work required at this site.

Please note that because the MDW Equity LLC owns the leaksite property, the Minnesota Department of Commerce may impose an environmental lien. Once costs have been incurred by MPCA for the fund financed work, please contact me regarding a possible referral of costs by the MPCA for the lien process.
